1. Scope and Who We Are

This Privacy Policy is issued by Fiber Construction Company LLC, a Texas limited liability company with its principal office at 5900 Balcones Drive STE 100, Austin, TX 78731 ("FCC," "we," "us," or "our"). It describes our practices with respect to information we collect through:

• our public website at fiberconstructioncompany.com (the "Site");
• the business intake forms we operate on the Site, including our contact and RFP form, subcontractor bid-list application, vendor and supplier application, and careers application;
• the secure, tokenized submission links we issue to business counterparties, including links for submitting invoices, production quantities, and compliance documents such as IRS Form W-9, contractor licenses, and certificates of insurance; and
• related business correspondence by email or phone.

This Policy addresses personal information, meaning information that identifies or can reasonably be linked to an individual. Information that relates only to a company rather than to an individual is generally outside the scope of privacy law, but we handle it under the same safeguards described here. Because we operate primarily in a business-to-business context, most of the personal information we hold is the business contact information of people acting for their employers.

2. Information We Collect

2.1 Information you provide to us

• Identifiers and business contact details: name, title or role, company name and affiliation, email address, phone number, business address, website, and social or professional profile links you choose to share.
• Commercial and capability information submitted through our subcontractor and vendor applications: trades and product categories, service areas and coverage states, crew counts and headcount, equipment, years in business, union status, bonding capacity, insurance limits, certifications, payment terms, lead times, and related business details.
• Professional and employment information submitted through our careers form: resumes and the work history, education, credentials, references, and contact information they contain.
• Financial, tax, and compliance documents submitted through secure links, including IRS Form W-9, contractor licenses, certificates of insurance, lien waivers, and invoices, together with data those documents contain.
• Communications: messages, notes, and other content you send us through forms, email, or phone.

2.2 Information collected automatically

• Usage and device data: IP address, browser and device characteristics, pages viewed, referring pages, and timestamps, collected through server logs and analytics cookies when you use the Site.
• Campaign attribution data: the channel, campaign, and landing page through which you reached the Site, collected through URL tags and first-party cookies so that we know which of our postings a submission came from.

2.3 Information from other sources

• Information our clients, your references, or publicly available sources (such as state licensing boards, corporate registries, and professional profiles) provide when we evaluate or verify a business relationship.

3. Sensitive Information

IRS Form W-9 contains a taxpayer identification number, which may be a Social Security number or an employer identification number. We treat taxpayer identification numbers, and any other government identifiers we receive, as sensitive information: we collect them only through secure, tokenized upload links or other secure channels, use them only for tax reporting, payment processing, and compliance purposes, restrict access to personnel who need them for those purposes, and do not use them for marketing. Please do not send W-9s or other sensitive documents through the general contact form or by unencrypted email; use the secure link we provide.

4. How We Use Information

We use the information described above for the following business purposes:

• evaluating, pre-qualifying, and onboarding subcontractors, vendors, and suppliers, and maintaining our bid and vendor lists;
• receiving, evaluating, and responding to project inquiries, RFPs, and bids;
• recruiting, evaluating, and communicating with job applicants;
• administering active business relationships, including contracts, purchase orders, work assignments, invoicing, payments, lien waivers, insurance verification, and required tax reporting and filings;
• contacting you about work, programs, and opportunities that match the capabilities, coverage, and preferences you provided;
• measuring the performance of our website and outreach channels and improving the Site;
• maintaining the security and integrity of our website, forms, and internal systems, including detecting and preventing spam, fraud, and abuse;
• establishing, exercising, or defending legal claims, and complying with applicable law, regulation, and lawful process; and
• evaluating or completing corporate transactions such as financings, reorganizations, mergers, acquisitions, or sales of assets.

5. How We Disclose Information

We do not sell personal information for money, and we do not disclose it to unrelated third parties for their own mass-marketing use. We disclose information in the ordinary course of business as follows:

• Clients and project partners. When qualifying, proposing, or staffing work, we may share subcontractor and vendor information (for example, company capabilities, coverage, key contacts, and compliance status) with the clients, general contractors, and program partners for whom the work would be performed.
• Affiliates and subsidiaries. We may share information within our corporate family, including parent, subsidiary, and commonly owned or controlled entities, for the purposes described in this Policy.
• Investors, lenders, and acquirers. We may disclose information to actual or prospective investors, lenders, acquirers, and their advisors, including private equity firms, in connection with financing, due diligence, or a corporate transaction such as a merger, acquisition, reorganization, or sale of some or all of our assets. If such a transaction closes, information may be transferred to the successor entity, which will remain subject to commitments materially consistent with this Policy or will notify you of changes.
• Service providers. We use third-party providers for hosting, email delivery, analytics, e-signature, document management, accounting, and payment processing. These providers process information on our behalf under agreements or terms that restrict their use of it.
• Professional advisors. We may share information with our lawyers, accountants, insurers, and auditors under professional duties of confidentiality.
• Legal and safety. We may disclose information when required by law, regulation, subpoena, or court order; to tax authorities in connection with required filings such as Form 1099 reporting; or when we believe disclosure is reasonably necessary to protect the rights, property, or safety of FCC, our personnel, our counterparties, or the public.

6. Cookies and Analytics

The Site uses Google Analytics to help us understand how visitors find and use it. Google Analytics sets cookies and collects device, usage, and approximate location information; Google's practices are described in its own privacy documentation, and you can opt out through the Google Analytics opt-out browser add-on. We also set first-party cookies to remember the campaign or channel that brought you to the Site. You can block or delete cookies through your browser settings; the Site remains usable without them. Our forms and business systems do not respond to browser "Do Not Track" signals, for which no common standard has been adopted, but you may exercise the choices described in Section 9.

7. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include encryption of data in transit, storage of uploaded documents outside public web access under randomized identifiers, role-based access controls in our internal systems, least-privilege database access, security headers and hardening on our web properties, and logging of administrative activity. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we review and improve our safeguards as our systems and obligations evolve. If we become aware of a breach affecting your information, we will notify you and regulators as required by applicable law.

8. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy and to satisfy legal, tax, accounting, contractual, and insurance obligations. Records connected to payments and tax reporting, such as W-9 forms, invoices, and lien waivers, are retained for the periods required by federal and state law. Bid-list, vendor, and applicant records are retained while a business relationship is active or reasonably prospective, after which they are deleted or archived under restricted access. When retention is no longer required, we dispose of information using reasonable secure-disposal practices.

9. Your Privacy Rights

Depending on where you live, you may have rights under state privacy laws (such as the Texas Data Privacy and Security Act or the California Consumer Privacy Act), including the right to:

• know whether we process your personal information and access a copy of it;
• correct inaccurate personal information;
• delete personal information, subject to legal retention obligations;
• receive a portable copy of information you provided; and
• opt out of targeted advertising, sales of personal information, or certain profiling. We do not sell personal information or use it for targeted advertising as those terms are commonly defined, so there is typically nothing to opt out of, but you may still submit the request.

To exercise any of these rights, email bids@fiberconstructioncompany.com with the subject line "Privacy Request" and tell us who you are, how you interacted with us, and what you are asking for. We will verify your identity using information we already hold, respond within the time required by applicable law, and will not discriminate against you for exercising your rights. Authorized agents may submit requests on your behalf with proof of authorization. If we decline a request, you may appeal by replying to our decision, and we will explain the outcome; residents of some states may also contact their state attorney general.

10. Communications Preferences

We contact the people who submit our forms about relevant business matters: work opportunities that match a bid-list profile, document and compliance requests, invoicing and payment matters, and responses to inquiries. Our intent is not to send bulk unsolicited marketing. If you no longer want to hear from us, email bids@fiberconstructioncompany.com and we will stop contacting you, except for communications required to complete an active transaction or meet a legal obligation, such as tax documents.

11. Children's Privacy

The Site and our forms are business tools directed to adults. We do not knowingly collect personal information from anyone under 16, and no part of the Site is directed to children. If you believe a minor has provided us personal information, contact us and we will delete it.

12. Third-Party Websites

The Site links to third-party websites and platforms, including social media and the IRS website for tax forms. Those sites operate under their own privacy policies, which we do not control and encourage you to review.

13. Changes to This Policy

We may update this Policy from time to time as our practices, systems, or legal obligations change. When we do, we will post the revised Policy on this page and update the effective date above. Material changes may also be communicated by email or a notice on the Site. Your continued use of the Site or our forms after an update constitutes acceptance of the revised Policy to the extent permitted by law.
